GENERAL TERMS AND CONDITIONS & ACCOMODATION RULESThe legal agreement set out below governs booking process and your accommodation in accommodation units/properties booked and/or managed by Smjestaj i to d.o.o., Rusici 6, 20213 Cilipi, Croatia (hereinafter: HEDERA ESTATE) during your stay in Dubrovnik and surrounding area during the time stated in HEDERA ESTATE CONFIRMATION OF RESERVATION note. To agree to these terms, click ''I AGREE'' If you do not agree to these terms, do not click "I AGREE". Please note that without clicking''I AGREE'' you may not proceed your booking process. Article 1 - Minimum stay The prices stated at our web-site are applicable for a 3-night minimum stay. HEDERA ESTATE reserves the right not to accept shorter stays. However, if shorter stays are accepted, higher prices shall be charged. Generally, for 2 nights stay shall be charged 30%, while for 1 night stay shall be charged 50% higher price. However, since the prices generally vary depending on the time of year the prices stated for shorter stay in the previous sentence may be reduced during the booking process and/or if pursuant to direct contact to HEDERA ESTATE on e-mails info@hedera-estate.com , contact@hedera-estate.com , booking@hedera-estate.com , vedran@hedera-estate.com , stijepo@hedera-estate.com , vesna@hedera-estate.com . Article 2 - Pets Pets are generally allowed in all our accommodation subject to prior notification. However, pursuant to notification HEDERA ESTATE reserves the right to refuse access to pets in particular accommodation. Article 3 - Payment Terms 3.1. Deposit - Conformation of Reservation You are required to pay a non-refundable deposit at the time of booking in order to confirm your reservation. This deposit varies by accommodation unit (from 15% - 30%), but it is typically 30% of the price for each night booked. In each booking process the amount of this deposit shall be stated in booking form, already presented to you at the beginning of this booking process. The announced prices in EUR. However, all payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian kuna according to the current exchange rate of the Croatian National bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site. The non-refundable deposit shall be charged on your credit card in accordance with procedure defined in Article 5. Acceptable credit cards are: American Express, MasterCard, Visa and Diners. 3.2. Balance Payment The balance is payable in cash upon arrival - at check in. Balance may be paid in either Euros or Croatian Kuna (HRK). Balance is not payable by credit card. If you do not feel comfortable traveling with a large amount of cash, HEDERA ESTATE is to be directly contacted in order to agree on payment method. Article 4 - Cancelation Any full or partial cancellation of the reservation prior to arrival will result in the forfeiture of the deposit paid for the canceled nights. In cases of partial cancellation, the deposit paid at the time of booking cannot be applied to the balance due for nights stayed. Deposit paid for in booking process for one accommodation unit cannot be applied for any other accommodation unit managed by HEDERA ESTATE. No refunds of the balance paid will be given for full or partial cancellations made after guests arrive at the property. In some cases the refund of the deposit and/or refund of the balance if a (partial) cancellation is made far enough in advance may be authorized. However, any such refunds cannot be guaranteed. Article 5 - Confirmation Within minutes of completing your reservation and paying the deposit, you will receive 2 automated emails. The first will be a "CONFIRMATION OF RESERVATION" email from us containing full details of your reservation including date of reservation, number of adults, number of children, number of nights booked, arrival and departure date, total price and amount of deposit. Second e-mail is from PayWay (payment processor) confirming your credit card has been successfully authorized. Third e-mail shall be sent, usually within next 24 hours, also by PayWay confirming that your credit card has been successfully charged. The Confirmation of Reservation becomes effective only upon successful charge of your credit card i.e. after receipt of the 3rd mail sent by PayWay from the previous paragraph. This effective Confirmation of Reservation is your official reservation confirmation. You must bring this email with you and present it upon arrival. If you do not receive this email (check all Junk and Bulk folders in addition to your Inbox since our emails are sometimes diverted there), please contact us on vedran@hedera-estate.com , stijepo@hedera-estate.com and we will re-send it to you. Article 6 - Arrival Information Once your reservation is confirmed, details of your arrival are to be agreed upon. Usually this is done by e-mail, and HEDERA ESTATE shall contact you. Check-in for our apartments is from 15:00 and for villas is from 17:00; check-out for all accommodation units is till 10:00. Staying in the accomodiation after that time unconditionally entails payment of 50 % of the daily rent without the possibility of further stay in the accommodation unit. Individual agreements on different check-in and/or check out time may be possible without extra charge, but it cannot be guaranteed. However, check-in and/or check-out between 00:00 and 06:00 are generally charged 28.00 EUR (200kn) per accommodation unit. Article 7 - Price Adjustments The prices listed on our website reflect the prevailing prices at a given point in time. By making a booking on our website you lock in the prevailing price. From time to time, HEDERA ESTATE may offer price discounts to generate last-minute bookings or raise prices to reflect improvements to the properties. In these cases, no price adjustments will be made to bookings that were made prior to the implementation of the price change. Article 8 - Accommodation Units Availability The availability calendars for all accommodation units are listed on our website and are 99% accurate. However, since our booking process is automatic it is possible that we receive more than one reservation at the same time. In this case, we will offer our customers the option of a full refund or will try to find them alternate accommodation of similar quality and price. However, in addition to the option offered in the previous sentence we accept no additional liability. Article 9 - Accommodation Unit Representations HEDERA ESTATE has done our best to assure that the descriptions and photographs on our website are an accurate representation of the accommodation units, and we accept no liability for any immaterial discrepancies. Article 10 - House Rules When checking in, it is implied that you are familiar with and agree with them, and that you fully adhere to them. Violation of house rules can result in the cancellation of the reservation, and charging the full amount of the price of the accommodation regardless of the shorter stay. - Upon arrival, submit identification documents of all guests to the HEDEARA ESTATE for registering with the local authorities. The documents shall be returned to you within 24 hours (5-10 minutes, usually). - HEDERA ESTATE changes your towels every 3 days and bed linen every 7 days. HEDERA ESTATE is not responsible for cleaning of the accommodation. Only the final cleaning is included in the price. - HEDERA ESTATE, owner and/or any other third person has no right to enter the accommodation or without prior announcement to and permission. However, if there is reason to believe that the accommodation or guest is in danger or that the guest violated the house rules HEDERA ESTATE and/or the owner may enter the accommodation. - IF A SWIMMING POOL IS LOCATED ON THE PREMISES OF THE ACCOMODATION, YOU USE OR SWIM AT YOUR OWN RISK. ALL SWIMMING POOLS LOCATED ON THE PREMISES OF THE ACCOMMODATION ARE SAFE FOR USE BY GOOD SWIMMERS ONLY. BAD OR NO SWIMMERS MAY NOT USE THE SWIMMING POOL AND/OR BE AROUND THE SWIMMING POOL. ACT CAREFULLY AND REASOBABLE WHEN IN OR AROUND SWIMMING POOL, DO NOT DIVE, RUN OR JUMP AROUND THE POOL. DO NOT TO LEAVE CHILDREN UNATTENDED IN OR AROUND SWIMMING POOL. GLASS CONTAINERS AND ELECTRONICS ARE NOT PERMITED NEAR SWIMMING POOL. - HEDERA ESTATE is at your service during your stay for all information and help. HEDERA ESTATE is not required or responsible to organize your leisure time and animate you. - Complaints about the quality of the accommodation or unkind treatment may be written in the book of complaints. - HEDERA ESTATE is not responsible for the guest's belongings, but will do anything in his or her power to protect and warn you of possible dangers. - Pets are allowed only with the permission of the host. Bringing pets without prior announcement in the reservation is not allowed, and HEDERA ESTATE has the right to cancel accommodation. - The guest is not allowed to bring easily inflammable and explosive materials and objects with a strong or unpleasant smell into the apartment. Moreover, the guest cannot bring electric appliances without the host's permission. The power consumption included in the price of accommodation does not include uncommon additional appliances that use electricity, and for every appliance found in the apartment, additional expenses will be charged in accordance with the estimated power consumption, regardless of whether they have been used or not. - From 11 p.m. to 7 a.m. is the period of night rest. From 2 p.m. to 5 p.m. is the period of day rest (siesta). So don't disturb the neighbors and/or other guests in the house. - Please take good care of the rented room or apartment, and turn of electric appliances and taps. Do not leave the air-conditioner on if there is no need for it, for example, while you are out of the apartment, and do not use it with open windows and doors. - It is strictly forbidden to bring persons who are not users of accommodation into the house or apartment. In case unregistered persons or persons that are not announced during reservation are found in the room, the host has the right to cancel accommodation. Guests from other apartments in the house or from other houses that are not managed by HEDERA ESTATE do not have the right to visit or stay in the apartment without HEDERA ESTATE explicit consent. - The guest who causes damage to property on purpose or by accident will have to make restitution for the full amount of damage. At the day of his or her departure, the guest is obliged to invite HEDERA ESTATE to check in his or her presence all rooms and house appliances to prove that they are not damaged. Only then is the guest allowed to depart. All unreported damages will be claimed afterwards in a lawsuit against the guest. - You are obliged to leave the room or apartment you rented as you found it upon arrival - clean, tidy and undamaged. If there will be found extremely unclean apartment or house with more than one-day garbage in it, extra cleaning service will be charged - 70.00 EUR for apartments and 200.00 EUR for villas. - The guest who violates house rules and disturbs the peace will be unconditionally refused accommodation. - In case HEDERA ESTATE cancels accommodation due to violation of house rules, the guest will be required to pay the total amount for accommodation during the reserved period, regardless of the shorter stay. - It is implied that, upon arrival and checking in, the guest is familiar with the house rules and agrees to obligations and conditions prescribed by it. Any disputes that cannot be resolved in agreement with the host will be resolved through police intervention or in legal proceedings before the court of Dubrovnik. Complaints will be considered only if they have been reported during the stay. Subsequent complaints will not be taken into consideration. If the guest doesn't comply with these provisions, he or she is obliged to leave the accommodation unit. Article 11 - Termination If you fail, or HEDERA ESTATE suspects that you have failed, to comply with any of the provisions of this Agreement, HEDERA ESTATE, at its sole discretion, without notice to you may: (i) terminate this Agreement and you will remain liable for all amounts due up to and including the date of termination. HEDERA ESTATE reserves the right to modify, suspend, or discontinue the service (or any part or content thereof) at any time with notice to you. Article 12 - Liability Disclaimer THE CARRIERS, AND OTHER SUPPLIERS PROVIDING TRAVEL OR OTHER SERVICES ON THIS WEBSITE ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF HEDERA ESTATE. HEDERA ESTATE IS NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM. HEDERA ESTATE HAS NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, STRIKE, FORCE MAJEURE OR OTHER CAUSES BEYOND THEIR DIRECT CONTROL, AND THEY HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR ACTS OF ANY GOVERNMENT OR AUTHORITY. IN NO EVENT SHALL HEDERA ESTATE, AND/OR THEIR RESPECTIVE SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, YOUR ACCESS TO, DISPLAY OF OR USE OF THIS WEBSITE OR WITH THE DELAY OR INABILITY TO ACCESS, DISPLAY OR USE THIS WEBSITE (INCLUDING, BUT NOT LIMITED TO, YOUR RELIANCE UPON OPINIONS APPEARING ON THIS WEB SITE; ANY COMPUTER VIRUSES, INFORMATION, SOFTWARE, LINKED SITES, PRODUCTS, AND SERVICES OBTAINED THROUGH THIS WEBSITE; OR OTHERWISE ARISING OUT OF THE ACCESS TO, DISPLAY OF OR USE OF THIS WEBSITE) WHETHER BASED ON A THEORY OF NEGLIGENCE, CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF HEDERA ESTATE AND/OR THEIR RESPECTIVE SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. If, despite the limitation above, HEDERA ESTATE or their respective suppliers are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then HEDERA ESTATE or their respective suppliers liabilities will in no event exceed, in the aggregate One-Hundred Dollars (US$100.00). The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of HEDERA ESTATE and/or their respective suppliers. Article 13 - Applicable law and jurisdiction The governing law shall be the law of Republic of Croatia. All disputes arising out of or in connection with this Agreement shall be finally settled under the Rules of Arbitration of the Permanent Arbitration Court at the Croatian Chamber of Economy by one arbitrator appointed in accordance with the said Rules. The seat of arbitration shall be in Zagreb and the language of arbitration shall be English. No information that can personally identify a visitor is stored. We collect no information on specific consumers who browse our Web page. The information we collect is used for internal review and is then discarded. With respect to cookies: We do not set any cookies on our Web page. If you supply us with your postal address on-line you will only receive the information for which you provided us your address. Persons who supply us with their telephone numbers on-line will only receive telephone contact from us with information regarding reservations or requests they have made on-line. With respect to Ad Servers: We do not partner with or have special relationships with any ad server companies. From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will contact you before we use your data for these new purposes to notify you of the policy change and to provide you with the ability to opt out of these new uses. Upon request we provide site visitors with access to all information [including proprietary information] that we maintain about them, financial information (e.g., credit card account information) that we maintain about them, transaction information (e.g., dates on which customers made purchases, amounts and types of purchases) that we maintain about them, communications that the consumer/visitor has directed to our site (e.g., e-mails, customer inquiries), contact information (e.g., name, address, phone number) that we maintain about them and a description of information that we maintain about them. Consumers can have this information corrected by sending us e-mail at the above address, calling us at the above telephone number or writing to us at the above address. Disclosure of Your identity Hedera Estate respects your privacy. Any correspondence between us and our guests is considered as strictly confidential. We guarantee that any information you give to Hedera Estate will be held with utmost care and will not be used in a ways that you have not consented to. Hedera Estate does not sell, rent, loan, trade, or lease any personal information collected on our site, including forms or email lists. We do not disclose the identities of our users unless we are legally required to do so or obtain your consent. If we receive a request by a legal authority we will contact the user whose identity has been requested using the contact information the user has provided. Secure Payment T-Com assures secrecy and security of your data during the authorization of credit cards. The security of data on these pages is provided through the use of Secure Socket Layer (SSL) security protocol with 128-bit encryption of data. The exchange of sensitive data (e.g. credit card numbers) between T-Com Pay Way system which performs online payment and credit cards authorization centers takes place via a private network which does not have access to the Internet and which is completely protected from unauthorized access, by using the ISO 8583 protocol. T-Com completely denies access to data which the participants in the trading process are not authorized to use.
